General Terms
1. General Agreement
By commissioning or purchasing art or character designs from me, Wolpertinkerly, you agree to the following terms and conditions. This applies to any digital and traditional art. This does not apply to physical merchandise produced in large quantities I may sell in shops.2. Copyright
I own the copyrights to all my work. You may not use my artwork for generative AI purposes, such as training, NFTs or commercial purposes (more on that below).3. Credit
If uploaded onto a site such as Toyhouse, you must credit me, Wolpertinkerly. If uploaded onto social media, you may credit me, especially upon first posting, but it is not required.
If you bought a design from me, you do not have to credit me every time you post any artwork of the design.Unless we have come to a prior agreement, I am free to post any commissioned artwork I have made on any site.In case one is present, do not erase my signature/watermark. This does not apply to necessary cropping, such as usage for profile pictures or banners.
Personal and Commercial Use
1. Personal Use
You may use commissioned/purchased art or designs for any personal purposes, such as using artwork for profile pictures, banners or emotes. You may make merchandise without any profit involved, such as anything intended as gifts, or personal use. This can include things such as free stickers or a shirt for yourself.
You may make some changes to my artwork with your own edits, such as color editing, cropping, usage of memes. Use of my artwork for hateful or inappropriate purposes may result in blacklisting you.You may not turn a design of mine into a Closed Species. For anything else akin to such, please contact me.2. Commercial Use
Commercial use does not come with my base prices in most cases. You may not sell my art or designs as merchandise or digital goods.
If you wish for commercial use, you may discuss this with me prior to purchase and in most cases will cost an additional fee.Unless we have come to a prior agreement, I will not sell commissioned work as merchandise, including fanart. I may only use it for displaying purposes, such as portfolios and social media.Commercial use is granted if a design is intended to include commercial use, such as fursuit designs. Allowing for commercial use will always be noted when I sell a design and is otherwise not the norm.Commercial use is granted if the type of artwork is intended to be used in a commercial manner, such as a design intended to be sold for keychains by the client. In such cases, it will be noted on the invoice.3. Exceptions to Commercial Use
You may use my artwork or designs for things such as twitch or discord emotes.
You may use my artwork or designs in videos that are monetized, as long as they are not the focal point.
You may use my designs in things such as monetized comics or webcomics, as long as they are insignificant background characters.
Payment
1. Payment
Unless there is prior agreement, I only take payment upfront. I take payment via invoices issued through either PayPal or Stripe. For artwork such as premade designs, they may be available in online shops such as Ko-Fi.
Payment will be done in Euros.2. Payment Plans
Unless there is prior agreement, I generally do not take payment plans.3. Refunds
You may ask for a full refund (any fees through payment sites not included) before I have started any work.
I do not offer refunds or partial refunds once the sketching stage is done. The commissioned artwork will be completed.
However if I have started the artwork but gone beyond the agreed upon deadline, I can offer a full refund.
Do not issue a chargeback. If you wish for a refund before I have started work, please message me.4. Notice of scams
Please always check who you are communicating with. I only use the usernames listed on my linktree and my email [email protected].
I am not responsible if you send money to someone else when intending to commission me.
I will never request payment through friends & family.
Commissioning Process
1. Prices
My prices may change at any given time.
I typically only offer specific types of commissions, but you may ask me for something else and I can give you a quote.
I may ask for an extra fee in case a commission is more complex.
I will only charge you what I have invoiced you upfront, and will not ask for additional fees unless you wish for major changes in the finished artwork that you could have asked me for at an earlier point (this does not include mistakes on my part).2. Requirements
I require clear visual references if drawing a character, I will not work based on a text description, unless it is intended for a new character design.
In most cases, I will not draw real people. I may also decline to draw fanart for media that I am unfamiliar with or refuse to draw for.
You may give me artistic freedom for things such as poses, or you may give me clear instructions. If given artistic freedom, do not repeatedly ask for changes unless they are a mistake on my part.3. Communication
You may communicate with me on most sites I have listed on my linktree or my email.
Once we have come to an agreement, I will require upfront payment via an invoice. Exceptions are anything bought via an online shop such as Ko-Fi.
If you wish for commercial usage, mention that upfront. This will likely include a fee.
You may speak casually with me, or professionally. I will adapt to how you communicate!4. Work in Progress
You can always follow the progress on my trello, but you also may message me at any given time.
You may ask for a refund if I have not started yet
Unless you decline being shown the artwork during the process, I will send you WIPs to approve of on the platform or email you communicate with me on.5. Changes to the Artwork
You may ask for changes during any shown stage of the artwork.
Major changes will only be allowed in the sketching process, or if I have gotten things visibly wrong in the final artwork despite clear instructions.
I may refuse any major changes once the artwork is done. Otherwise, it may cost an additional fee.
Excessive unreasonably repeated requests for changes, including during the sketching process, may cost an additional fee.6. Timeframe
I will take a maximum of two months to finish artwork. In most cases, especially smaller scale pieces, it will likely be faster.
If there are any unexpected delays for any reason, I will communicate those.
If you require something to be done by a specific point of time, please inform me beforehand. If it needs to be done fast, I may require a rush fee.
If I take longer than that, despite having started the artwork, I will offer a full refund (not including fees issued through a payment site) if so desired by the client.7. Delivery
Once finished, I will deliver you the full resolution files as .pngs and .jpegs, unless another format was used, such as anything animated.
For digital artwork, there will be NO physical product delivered.8. Cancellation
I may decline any commissions without having to state the reason.
If I cancel a commission during the process for any reason on my end, I will issue a full refund (not including fees issued through a payment site).
Please be polite. Aggressive or rude behavior may lead to me canceling the commission. In such cases, if the artwork has already been started, I will only offer a partial refund depending on the progress.
Adoptable and Design Terms
1. Toyhouse
In most cases, I will upload my designs onto the website Toyhouse. If sold to a client on Toyhouse, they will be transferred to said client. If they are sold to someone who does not have Toyhouse, I will keep them in a folder marked as Sold, and they will not be available for purchase anymore.2. Personal and Commercial use
The same terms as above apply.
If you wish for full commercial rights, you may discuss this with me.
If the design is intended and openly marked for commercial use, such as fursuit designs, you have full commercial use for the design, but you may not make merchandising off the art I have made.3. Trading and Gifting
You may trade or gift designs you have purchased from me without any restrictions.4. Reselling
You may resell a design I have made for the amount you bought it for if there is no additional art.
Once there is additional art of the design, whether it is self-made or commissioned, you may resell them for more than you have originally paid. There is no limit, you do not have to add up the values of each self-made or commissioned art piece.
Do not count gift art, whether acquired by a friend or other means, for this, unless the maker of the gift art is okay with it.
Reselling designs I made gifted by me or acquired through other free means, such as a raffle, is allowed as long as there is additional art.Be reasonable and do not abuse this rule. If I am made aware of repeated offenses, such as buying my designs, drawing a quick doodle, then reselling for much more than originally bought, I may blacklist you and exempt you from this rule.5. Changes to the Design and Artwork
Editing my artwork on a small scale is allowed if so desired. You may change elements such as the color palette, markings, and outfits. You may not edit my artwork in an offensive or hateful way.
If you do edit my artwork, I request you keep a copy of the original and mark anything with more visible edits as being edited.
Do not erase my signature or watermark if there is one present.You may make new artwork, such as a new reference sheet, based on my design. It may also include any desired changes to the design.If you need help with any small design changes, you may message me about them as I keep most of my files. Anything on a small scale will not cost anything additional.6. Credit
You do not have to credit me every time the design is used in things such as social media posts, especially in artwork made by anyone other than me, Wolpertinkerly.7. Co-Ownership
You MAY co-own a design of mine, but please do not create additional character profiles of the same character on the same website. Please be mindful and only do this with someone you fully trust, I will not be involved in any disputes over co-ownership.
By commissioning or purchasing art from me, Wolpertinkerly, this means you have properly read, understood, and agreed to the terms listed above and on the invoice.Terms and Conditions may be subject to change at any given time.
